Portal’s Terms of Use
Access to THE WEBSITE attributes the status of USER and implies full and unconditional acceptance of all the conditions established in this LEGAL NOTICE. These conditions aim to regulate both the provision of information and the commercial relationships that may arise between ARMATIS and the users of THE WEBSITE.
If the USER decides to use any of the services managed by THE WEBSITE, they must expressly and previously accept all the terms and conditions included in this LEGAL NOTICE, the PRIVACY POLICY, and the COOKIE POLICY. Therefore, if the USER does not agree with each and every one of the established conditions, they should refrain from using THE WEBSITE.
There are conditions within this LEGAL NOTICE that refer to the use of a specific service and solely affect the relationship established between ARMATIS and the USERS of such services, without affecting other users of the website who are not registered for those services.
ARMATIS may modify or update the content of this LEGAL NOTICE in whole or in part, taking into account any changes in legislation and applicable regulations. Each new version of the LEGAL NOTICE will be effective from the date of its publication on THE WEBSITE. The USER must review its content each time they access the website. If the USER does not agree with any changes that may occur, we kindly ask that they do not use THE WEBSITE.
It is permitted to establish electronic links directed to THE WEBSITE as long as they do not alter, falsify, limit, or modify in any way the content or presentation of the pages that make up THE WEBSITE as designed by ARMATIS.
ARMATIS is not responsible for the content of third-party websites to which THE WEBSITE establishes links. If at any time it becomes aware of the unlawfulness of all or part of their content, the established link to that website will be automatically removed.
Responsibility of ARMATIS
ARMATIS shall be liable for the damages that the USER may suffer as a result of using THE WEBSITE, provided that such damages are directly attributable to willful misconduct or negligence on the part of ARMATIS, and there is no fault or negligence on the part of the USER. In any case, there shall be no willful misconduct or negligence on the part of ARMATIS when it proves that it has complied with the legally established requirements and obligations and the other care and diligence required by the nature of the service provided.
The information society services offered on THE WEBSITE that are not subject to prior contracting are provided to the USER without requiring any consideration. They only entail the obligation for the USER to comply with the rules of use established in this LEGAL NOTICE. ARMATIS does not undertake to comply with specific availability levels of THE WEBSITE or to adopt specific security measures. Likewise, ARMATIS may suspend, withdraw, or cancel partially or entirely the non-contractual services at any time and without prior notice. In the event of such cancellation, it will not affect the services that are subject to prior contracting, which will continue as agreed with those USERS.
The Internet connection necessary for accessing THE WEBSITE is not provided by ARMATIS under any circumstances and is the responsibility of the USER. The USER is informed that communications over open networks are not secure. It is the responsibility of the USER to take all appropriate technical measures to reasonably control these risks and prevent damage to their equipment, data loss, or theft of confidential information. To this end, it is recommended to use up-to-date malicious software detection systems and keep the browser security patches updated when accessing THE WEBSITE.
Obligations of the USER
In general, the USER undertakes to comply with the conditions established in this LEGAL NOTICE. Likewise, the USER undertakes to act in accordance with the law, good customs, and the requirements of good faith, using the diligence appropriate to the nature of the service they enjoy and refraining from using THE WEBSITE in any way that may impede, damage, or impair its normal operation, the assets or rights of ARMATIS, its suppliers, other users, or, in general, any third party.
In particular, and without implying any restriction on the obligations assumed by the USER in general established in the previous section, the USER undertakes to:
- Provide accurate data when registering and keep them updated.
- Not introduce, store, or disseminate any information or material through THE WEBSITE that is defamatory, libelous, obscene, threatening, xenophobic, incites violence, discrimination based on race, sex, ideology, religion, or in any way infringes upon morality, public order, fundamental rights, public liberties, honor, privacy, or the image of third parties.
- Not introduce, store, or disseminate any software, data, virus, code, or any other electronic or physical instrument or device through THE WEBSITE that is capable of causing damage to THE WEBSITE, any of the managed services, or any of the equipment, systems, or networks of ARMATIS, any user, the suppliers of ARMATIS, or, in general, any third party.
- Safeguard properly the “username” or “email address” and the “password” assigned for accessing the services, and not to transfer their use or allow access to them by third parties, assuming responsibility for any damages that may arise from their misuse. The USER also agrees to notify ARMATIS as soon as possible in case of loss, theft, or mere suspicion of their use by a third party.
- Not carry out advertising, promotional, or commercial exploitation activities through THE WEBSITE, nor use the content or information obtained through it to send advertising, sales messages, or any other commercial purpose.
- Not use false identities or impersonate the identity of others in using THE WEBSITE or in using any of the services offered on it, including the use of passwords or access keys of other users.
- Not use, destroy, alter, disable, or damage the data, information, programs, or electronic documents of ARMATIS, its suppliers, or third parties.
- Not introduce, store, or disseminate through THE WEBSITE any content that infringes intellectual or industrial property rights, intimate, personal, or confidential information of third parties, or, in general, any data for which the USER does not have, in accordance with current legislation, the right to make it available to a third party.
Communications
For any necessary communication between ARMATIS and the USER, they must be directed by email to info@armatis.es or by traditional mail to ARMATIS, Ronda de la Circunvalación, nº 188 (Edificio CEEI), 12003 – Castellón de la Plana (Spain).
Communications from ARMATIS to the USER will be made according to the data provided by the USER in the forms provided for this purpose on THE WEBSITE, or, if not available, to the address stated in the last written communication sent by the USER.
The USER expressly accepts, for all communications related to the use of THE WEBSITE and/or the contracting of the services offered on it, the use of email as a valid method for sending such communications. The USER also accepts that announcements directly posted on THE WEBSITE are a valid means of communication.
Intellectual Property, Industrial Property, and Image Rights
All content present on THE WEBSITE, including designs, texts, images, photographs, videos, logos, source codes, the selection and presentation of materials included therein, as well as their structure and design, are subject to intellectual property rights belonging to the owner of THE WEBSITE, or their use has been authorized with limitations by their owners. Therefore, any total or partial reproduction, public communication, modification, transformation, copying, distribution, or any other form of exploitation and manipulation of these elements is strictly prohibited. Disclaimer
ARMATIS is not responsible for the misuse that the USER may make of the content of THE WEBSITE and reserves the right to update, modify, preserve, delete, or prevent access to any content that appears on it or to close it without prior notice.
ARMATIS shall not be liable for any possible damages or harm that may arise from interferences, omissions, interruptions, computer viruses, telephone faults, or disconnections in the operational functioning of this electronic system caused by external factors. Nor shall it be liable for delays or blockages in the use of this electronic system caused by deficiencies or overloads in telephone lines, the Internet system, or other electronic systems, as well as for damages that may be caused by third parties through illegitimate intrusions outside the control of ARMATIS.
ARMATIS shall not be liable for any infringements committed by the USER that violate the rights of another user of THE WEBSITE or third parties, or that affect copyright, trademarks, patents, confidential information, or any other industrial or intellectual property rights.
Applicable Law
The relationships established between ARMATIS and the USER through THE WEBSITE shall be governed by Spanish law, except in cases where, as a consumer, more advantageous provisions of mandatory application to the USER are applicable.
